BAPETEN Hearing with the Directorate of Non-Tax State Revenue (PNBP) of the Ministry of Finance on the Revision of PNBP Regulations Applicable to BAPETEN

BAPETEN held a hearing with the Directorate of Non-Tax State Revenue for Ministries/Agencies (PNBP KL) of the Ministry of Finance regarding the revision of regulations on non-tax state revenue applicable to BAPETEN on Tuesday, 31 March 2026 at the Office of the Director of PNBP KL, Ministry of Finance. This hearing was conducted as a follow-up to the proposed revision of Minister of Finance Regulation Number 137/PMK.02/2021 concerning the Types and Tariffs of Non-Tax State Revenue of a Volatile Nature and Urgent Needs at the Nuclear Energy Regulatory Agency (Revision of PMK 137), as well as the drafting of a Government Regulation in Lieu of Government Regulation Number 42 of 2022 concerning the Types and Tariffs of Non-Tax State Revenue Applicable to the Nuclear Energy Regulatory Agency (Draft PNBP Government Regulation).

The hearing was attended by Ririn Kadariyah, Director of PNBP for Ministries/Agencies at the Ministry of Finance, along with relevant staff Mukhlisin, Director of Regulation for the Supervision of Radiation Facilities and Radioactive Substances (DP2FRZR) of BAPETEN Asep Syaifulloh Hermawan, Director of Licensing for Radiation Facilities and Radioactive Materials (DPFRZR) of BAPETEN; as well as representatives of the BAPETEN PNBP drafting team.

The event commenced with opening remarks by Ririn Kadariyah, who stated that Non-Tax State Revenue (PNBP) constitutes government levies that may only be imposed in accordance with the provisions stipulated in prevailing laws and regulations. The government is obliged to support the growth of the business sector by providing optimal services. Not all types of services delivered by the government to business actors are subject to PNBP charges, as part of the government’s support for the development of the business sector in Indonesia.

In his remarks, Mukhlisin stated that BAPETEN has provided various forms of support to the business sector by setting a zero-tariff policy for several types of services. In addition, the planned revision of the Government Regulation on BAPETEN PNBP will include the simplification of the types of PNBP applicable to the agency. At present, BAPETEN needs to promptly adjust its PNBP regulations following the enactment of Government Regulation Number 28 of 2025 on the Implementation of Risk-Based Business Licensing and BAPETEN Regulation Number 5 of 2025 on Business Activity Standards and/or Product/Service Standards in the Implementation of Risk-Based Business Licensing in the Nuclear Sector.

During the discussion session, deliberations covered the exemption of licensing fees for certain activities whose types and tariffs have not yet been regulated under the PNBP provisions applicable to BAPETEN, efforts to accelerate the revision of Minister of Finance Regulation Number 137 of 2021, adjustments to the components forming PNBP tariffs at BAPETEN, and the potential PNBP revenue derived from penalties imposed on expired licenses.
