Focus Group Discussion of Community Participation in the Harmonization of the Draft Law on Nuclear Energy (RUUK)

The Focus Group Discussion (FGD) activity for the Draft Nuclear Energy Law (RUUK) was held by the Ministry of Law and Human Rights (Kemenkumham) in a hybrid manner in Semarang City, Central Java, on Thursday, June 27, 2024. This FGD was attended by regional governments, universities, associations, business actors, and other stakeholders.

Present in this activity were representatives of BAPETEN as the initiator of the RUUK, including the Deputy Chairman for Nuclear Safety Assessment (PKN), Haendra Subekti; Director of Regulation of Radiation Facilities and Radioactive Materials, Muklisin; Head of Bureau of Legal Affairs, Cooperation and Public Communication, Indra Gunawan; and Acting Director of Regulation of Supervision of Nuclear Installation and Materials, Nur Syamsi Syam.

The activity was opened by the Director of Harmonization of Laws and Regulations (PUU) II, representing the Director General of PP of the Ministry of Law and Human Rights, Unan Pribadi. Unan said, "Law 13 of 2022 states that in the formation of laws and regulations, public consultation is needed; in order to realize effective regulations, it must meet the principles of being implemented, efficiency, and openness," he continued. The activities carried out today are part of the process for strengthening and harmonizing the amendment to Law 10/1997, which invites stakeholders to increase their role and synergy with nuclear parties for peaceful purposes.

The event continued with the first presentation on the four pillars of nuclear law in the RUUK presented by the Head of Research on Nuclear Technology Management and Regulation, Faculty of Law, Airlangga University, Intan Innayatun Soeparna. "According to the IAEA: Nuclear Law Global Debate 2022, the nuclear law not only answers questions about safety, security, safeguards, and liability for losses related to nuclear power plants (NPPs) but also its relationship to the SDGs (food security, clean energy, environmental protection, etc.), culture (safety and security), technology development (including cyber nuclear and AI), and public-private partnerships," Intan began her presentation. Intan continued her presentation by explaining the 4 pillars of nuclear regulations based on the IAEA 2022, namely the safety pillar, the security pillar, the guard pillar, and the nuclear loss liability pillar. Furthermore, Intan outlined the legal principles and procedures related to nuclear loss liability.

The second presentation by Wahyu Setiabudi from the Department of Physics, Faculty of Science and Mathematics, Diponegoro University, with the theme of Amendments to the Nuclear Power Law in Improving Public Health and the Ionizing Radiation-Based Medical Device Industry. Prof. Wahyu said that in this RUUK, the health sector has become more specific, the diagnostic and interventional radiology section, which was previously only regulated in the Government Regulation, is now in this Nuclear Energy Bill. Wahyu further explained several developments in science and technology in radiation equipment in the health sector, radiation protection of facilities, and also domestic research products.

The third presentation by Deputy PKN BAPETEN Haendra Subekti with the theme "Strengthening the Nuclear Energy Law to Improve Public Health, Safety, and Security and Environmental Protection from Climate Change." Haendra explained comprehensively about issues related to nuclear energy both nationally and internationally. In addition to nuclear energy issues, he also explained the main regulations in this RUUK. Haendra also mentioned the need for community and international participation in nuclear energy, which is also included in one of the chapters in this RUUK.

The FGD was continued with a discussion session. Several things were discussed during the discussion session, such as the potential risk of nuclear misuse, the use of nuclear in the industrial sector, the use of domestic products, transportation problems, and a quick look at the systematics of the nuclear power bill.
