Regulatory Guidance Activity on Radiation Facilities and Radioactive Materials

The Nuclear Energy Regulatory Agency (BAPETEN), through the Directorate of Regulation of Radiation Facilities and Radioactive Materials (DP2FRZR), held an offline guidance activity on radiation facilities and radioactive materials regulations on Thursday, August 7, 2025, at BAPETEN.

This activity was held in conjunction with the enactment of Government Regulation (PP) No. 28 of 2025 on the Implementation of Risk-Based Business Licensing. Guidance is a crucial process following the issuance of legislation. This opportunity provided guidance for licensing evaluators, particularly in the field of radiation facilities and radioactive materials, with the aim of disseminating PP No. 28 of 2025 so that the regulations can be implemented effectively and the licensing process can run smoothly.

The event was opened by the director of DP2FRZR, Mukhlisin, who stated that this activity was held as a follow-up to the enactment of PP No. 28 of 2025. This Government Regulation (PP) has implications for licensing requirements and procedures, as it simplifies licensing requirements and changes to the SLA (Standard Operating Procedures). The purpose of this activity was to provide an explanation of the key elements that will directly impact the Directorate of Licensing of Radiation Facilities and Radioactive Materials (DPFRZR) and the Balis system, to establish a common understanding of the provisions, and to identify potential challenges and the need for implementing regulations currently being drafted.

The activity continued with a briefing from Haendra Subekti, Deputy Chairman for Nuclear Safety Assessment. Haendra stated that understanding PP No. 28 of 2025 on the Implementation of Risk-Based Business Licensing, both in substance and concept, is crucial for evaluators as frontliners in the licensing process.

"If technical matters require more detailed explanations, they should be provided for implementation in implementing regulations. If the enactment of this government regulation requires changes to the existing SOPs for licensing, the DPFRZR must immediately adjust the SOPs to streamline the licensing process," he continued.

The event continued with a presentation on Government Regulation No. 28 of 2025 on the Implementation of Risk-Based Business Licensing, delivered by Radiation Supervisor, Vatimah Zahrawati. Vatimah explained the roadmap for the development of risk-based business licensing; the policy direction for the revision of Government Regulation No. 5 of 2021; a comparison of Government Regulation No. 5 of 2021 with the amendments to Government Regulation No. 28 of 2025; general provisions covering the scope and systematics of the regulations of Government Regulation No. 28 of 2025, business licensing and UMKU business licensing, general NSPK, types of PB and PB UMKU business actors, the concept of supervision, and points of revision to Government Regulation No. 5 of 2021, transitional and closing provisions, and the concept of positive fiction in the basic requirements; and business licensing in the nuclear energy sector, including PB and PB UMKU (Nuclear Energy Business License), permit validity provisions, provisions on the issuance period for business permits, supervision and sanctions in the nuclear energy sector, and Attachments I and II for the nuclear energy sector.

The guidance session concluded with an interactive Q&A and feedback session on Government Regulation No. 28 of 2025. Participants sought clarification on licensing workflows, sanctions, required documentation, licensing SLAs, radiation worker qualifications, the application of the deemed approval principle, permits for container inspection using ionizing radiation sources, and transitional provisions. In his closing statement, Mukhlisin stated that this forum is important and should be held periodically to ensure harmonization between regulations and implementation by the DPFRZR.
