Guidance on Government Regulation No. 45 of 2023

In order to strengthen regulatory understanding and build cross-sector synergy, the Nuclear Energy Regulatory Agency (BAPETEN), through the Directorate of Regulation of Nuclear Installations and Materials (DP2IBN), held its first guidance session on nuclear energy legislation for 2025 on Thursday, April 24, 2025, discussing Government Regulation No. 45 of 2023 on Ionizing Radiation Safety and Radioactive Material Security. The event was attended by 100 participants representing government agencies, business actors, and various stakeholders related to the use of nuclear energy in Indonesia.

The Director of DP2IBN, Nur Syamsi Syam, in her report, stated that this activity embodies the implementation of Law No. 12 of 2011 on the Establishment of Legislation, which has been amended by Law No. 13 of 2022. She said that disseminating regulations is not only about conveying information but also respecting the rights of the public and stakeholders, namely the right to be heard, the right to have their opinions considered, and the right to receive an explanation.

"This guidance is part of our annual routine work, which is carried out in various formats, both online and offline, and through digital platforms," she said. This year, DP2IBN will hold four guidance activities: two online and two offline.

Acting Deputy Chairman for Nuclear Safety Assessment at BAPETEN, Taruniyati Handayani, opened the event with remarks highlighting the important role of regulations in supporting the safe and responsible use of nuclear energy. She also touched on Indonesia's grand vision towards Net Zero Emissions (NZE) 2060, which has been included in the RPJPN Roadmap, including the plan to operate the first commercial nuclear power plant in 2030–2034.

"The energy transition is not just about new and renewable energy but also about ensuring safety, security, and safeguards—the 3Ss: safety, security, and safeguards—which are a key part of Government Regulation No. 45 of 2023," said Taruniyati. She added that BAPETEN is also preparing a domestic product certification scheme to support the independence of the national nuclear industry.

The technical presentation session was delivered by the Senior Radiation Supervisor, Dahlia Cakrawati Sinaga, who comprehensively explained the regulatory hierarchy, the substance of Government Regulation No. 45 of 2023, and its relationship to Law No. 10 of 1997, which has now been partially amended through the Job Creation Law. This Government Regulation regulates all uses of nuclear energy, including radiation facilities, nuclear installations, and the mining of nuclear minerals.

The training participants enthusiastically asked questions for discussion. The discussions focused largely on the actors responsible for safety, the role of local governments, particularly in the event of a nuclear emergency, inter-agency coordination, the implementation of Government Regulation 45 of 2023 for nuclear power plants, and the technical mechanisms for implementing the regulation.

With this activity, BAPETEN affirmed its commitment to overseeing the safe, secure, and compliant use of nuclear energy and opened the widest possible space for active dialogue between regulators and stakeholders.
