Public Consultation on the BAPETEN Regulation Draft on Licensing and Business Standards in the Nuclear Sector

The Nuclear Energy Regulatory Agency (BAPETEN) held a public consultation on its BAPETEN Regulation Draft (Raperba) on licensing and business standards in the nuclear sector, conducted both offline at the BAPETEN Building B and virtually on August 28, 2025. The event focused on a replacement draft regulation that integrates two existing BAPETEN regulations: Regulation No. 3 of 2021 on business activity and product standards for risk-based business licensing in the nuclear sector and Regulation No. 1 of 2022 on the administration of risk-based business licensing in the nuclear sector.
The event opened with a report on the preparations by Mukhlisin, the Director of Regulation of Radiation Facilities and Radioactive Materials. He noted that this forum represents a crucial step in regulatory refinement following the issuance of Government Regulation (PP) No. 28 of 2025 on the Implementation of Risk-Based Business Licensing, which mandates that implementing regulations be issued no later than October 5, 2025. The consultation aims to communicate the latest policies, open a dialogue with stakeholders, gather input to ensure the regulations are practical, provide legal certainty, and accelerate the licensing process, all without compromising safety guarantees for workers, the public, and the environment.
In his remarks, Haendra Subekti, the Deputy Chairman for Nuclear Safety Assessment, stated that the new regulations are designed to be more adaptive, streamlined, and transparent through digital systems, while still ensuring safety protections and legal certainty for the business community. "This forum provides an opportunity for the public and business players to offer input, thereby upholding the principle of participation. We expect the results of this public consultation can be finalized quickly to expedite the harmonization phase, support a safe investment climate, and foster public welfare," he said.
Meanwhile, the Deputy Chairman for Licensing and Inspection, Zainal Arifin, emphasized that the use of radiation sources and nuclear installations must always prioritize safety, security, and safeguards for the well-being of the public and the nation. He also stressed the importance of inter-ministerial and inter-agency collaboration in implementing Government Regulation (PP) No. 28 of 2025, as well as the need for more adaptive licensing processes via the Online Single Submission (OSS) system, without compromising legal certainty or safety standards.
Participants in the event came from various fields, including BRIN (National Research and Innovation Agency), hospitals, facilities that use irradiators, industries that do non-destructive testing, dosimetry labs, educational and training organizations, professional groups, and other related government ministries and agencies. The main agenda featured three presentations:
- Business Licensing Policy following the issuance of PP No. 28 of 2025, presented by Ichsan Zulkarnaen, Assistant Deputy for Investment Acceleration and Downstreaming at the Coordinating Ministry for Economic Affairs of the Republic of Indonesia.
- OSS System Development Policy following the issuance of PP No. 28 of 2025, presented by Wahyudi, representing the Director of Investment Deregulation at the Ministry of Investment/BKPM (Investment Coordinating Board) of the Republic of Indonesia.
- Regulatory Direction for the Revision of BAPETEN Regulation No. 3 of 2021 and BAPETEN Regulation No. 1 of 2022, presented by Nanang Triagung Edi Hermawan, Lead of the BAPETEN Regulation Drafting Team, alongside Asystasia Sabathrin Cindananti, a drafter specializing in nuclear installations and materials.
