Internal Guidance Regarding the Implementation of Government Regulation Number 28 of 2025

The Directorate of Regulation of Nuclear Installation and Materials (DP2IBN) of the Nuclear Energy Regulatory Agency (BAPETEN) held an internal guidance on legislation, covering Government Regulation (PP) Number 28 of 2025 on the implementation of risk-based business licensing. The event took place on Monday, July 28, 2025, in the Auditorium on the 8th Floor of Building B, BAPETEN, and was attended by employees from various work units within BAPETEN.

The event began with a report from the Director of DP2IBN, Nur Syamsi Syam, who stated that this guidance fulfills the mandate of Law Number 12 of 2011, which emphasizes the responsibility of disseminating regulations to the public and stakeholders. The material presented in this guidance was PP 28 of 2025, which replaces PP 5 of 2021. The Director of DP2IBN encouraged all participants to understand and provide input on the implementation of this regulation.

"This activity is part of the regulatory development task as stipulated in BAPETEN Regulation No. 9 of 2020, Article 9. We want to deepen understanding of the regulations that have been enacted before external development is conducted," said Nur Syamsi.

The event was officially opened by the Deputy Chairman for Nuclear Safety Assessment, Haendra Subekti. In his opening remarks, he emphasized the importance of adapting regulations and systems in a short time since PP 28 was enacted in June 2025.

"We must shift our mindset to focus on post-licensing activities and how our systems can support risk-based principles," he said. He also encouraged every employee to understand the contents of the regulations not only through development but also through in-depth independent reading.

Also delivering remarks, the Director of Licensing of Nuclear Installation and Materials, Wiryono, expressed his appreciation for the organization of this activity. He believes this type of coaching is very helpful in accelerating understanding of the substance of Government Regulation No. 28 of 2025.

"If we simply read the articles one by one, it would be difficult, but with direct explanations in a forum like this, we can more quickly understand and apply the precautionary principle in implementing licensing," he said.

As a resource person, Farid Noor Jusuf, the executive for non-reactor nuclear installation regulation from the DP2IBN, explained the scope and important substance of Government Regulation No. 28 of 2025. The material presented covered business activity risk classification, licensing mechanisms, authority and implementation of supervision, law enforcement, and sanctions for violations of business licensing.

During the discussion session, participants actively expressed their views and questions related to the graded approach for licensing, technical document control, permit validity periods, potential regulatory overlaps with other ministries/institutions, financial guarantees, and BAPETEN's authority in the licensing process.

This activity is part of an effort to strengthen legal and regulatory understanding for all BAPETEN employees while also supporting the smooth implementation of national policies to increase the effectiveness and accountability of regulation. (DP2IBN/Zakki/BHKK/Ra/Translator: GP)
