BAPETEN Collaborates with Gadjah Mada University, Holding a Legal Guidance and Counseling Workshop
Kembali 20 September 2024 | Berita BAPETENThe Nuclear Energy Regulatory Agency (BAPETEN), in collaboration with the Faculty of Law, Gadjah Mada University (UGM), held a Legal Guidance and Counseling Workshop for BAPETEN employees, which was held at the BAPETEN Office, Jakarta, on Friday (20/9/2024).
This event was opened directly by the Deputy Chairman for Nuclear Safety and Assessment, Haendra Subekti, in his presentation "The Nuclear Energy Regulatory Agency (BAPETEN) itself already has a National Legal Documentation and Information Center (JDIH) website, which is exposed to the number of both BAPETEN Chairman Regulations and BAPETEN Chairman Circular Letter, furthermore, with the many legal problems that exist in BAPETEN, employees often lack a qualified legal reasoning basis so that they often have difficulty in formulating legal opinions (legal opinions and/or legal audits). For that reason, this workshop is very good and important for future learning."
In addition, this activity was also attended by the Head of Education and Training Division Ahmad Ciptadi Syuryavin and the Secretary of the UGM Faculty of Law (FH UGM) Study Program, Head of Jakarta Campus, Agustina Merdekawati. The workshop was attended by 62 participants from several work units within BAPETEN.
Also present were a number of speakers from UGM, such as Lecturer in Criminal Law-FH UGM, Muhammad Fatahilah Akbar; Lecturer in Business Law-FH UGM, M. Hawin; Lecturer in Constitutional Law-FH UGM, Dian Agung Wicaksono; and Lecturer in International Law-FH UGM, Agustinus Supriyanto.
This legal guidance and counseling workshop for BAPETEN employees is very important considering that state institutions tend to develop in such a way along with the needs and situational developments. As found, one regulation in BAPETEN has a different format. This causes confusion for implementers, especially related to technical functions in BAPETEN.
However, it is reasonable if we refer to Bill Number 12 of 2011 on the Formation of Legislation; then there is indeed a special format for Ministerial Regulations, but not for other legal products such as Ministerial Decrees and Circulars.
In addition, as a government institution with many technical regulations, a more in-depth study is certainly needed in compiling a product of legislation, such as the Regulatory Impact Analysis (RIA).
BAPETEN itself is currently discussing the creation of ratification related to nuclear liability, the problem of exporting commodity goods that are rejected in recipient countries due to contamination, and also legal problems in border countries, especially waters. This also needs attention and the right legal approach solution.
It is hoped that with this event, BAPETEN employees, especially those working in the technical unit for compiling regulations, can understand the theory, principles, and legal rules in compiling legislation, analyze the impact of the regulations that have been made, and implement them in resolving legal problems currently being faced.
